Do you own these games in carts? If so, it should be fine. If not, just don't bring it out to the public. Lol but too late for that. -

Nintendo closed down the 3DS EShop recently, so it's not like there's any legal way to get some of those games. -

We have carts for most of them. Stuff like Sonic Gens and Photos with Mario however, we do not. I just hope we don't get in any trouble. My brother's in enough hot water already... -

I should mention, your brother actually hasn't pirated anything. Piracy is when you download something that you're expected to pay for, and illegally provide the download link to other people for free. All your brother is doing is downloading things that someone else pirated.
Point is, you're probably not in danger of any legal action. If anything, the site which your brother got the downloads from is. -
