An interesting hypothetical rape case...

 Not sure if this goes here, but whatever.

So I came up with this idea for a case a while ago and it was brought back to my attention today as we spoke of the subject in my Criminal Justice class...

The scenario is: a woman files sexual assault against a man. The man claims that he did have sex with her, but that it was consensual, and was not sexual assault.

My question is this: since he admits that they had sex, and this can be proven, how would her consent be proven or unproven? I have thought about it and it seems to me that the only evidence to either would be their own biased testimonies as the only witnesses.

Yaknow.. once there was a chick on YAHOO ANSWERS.. Yahoo freaking answers asking if there was a good way to compromise a condom to get the dude she liked to get her preggo.

I guess that's what happens when people don't have dreams of their own. The funny thing is, I guess that means they're worried about their BF leaving them. Whatever happened to good ol' love?

The most important meal of the day
 Most judges are smart people who can combine the evidence with how both parties appear in court.
They can usually tell if one of them is lying or at least overexaggerating.

At the end of my freshman year (not too long ago), I had this friend. She was above and beyond promiscuous, EVERYONE knew that, she even called herself a hoe. She did everything with everyone who was willing (and in my town, well my old town, that was a large percentage). She also claimed to be bisexual, so she got twice the action, you know?

Anyways, one day she started this big commotion after school claiming she had been orally raped by this senior guy we were all friends with..
Well, it was hard to believe her, because giving out..uh, you know..after school was kind of her thing. But word got around and she missed school and cried some crocodile tears so some people believed her. She totally ruined that guy's reputation, as well as his senior year.

Finally she went to court. Apparently she couldnt deal with the pressure because by now her story just wasnt matching up and everybody could tell she was lying. So she admitted to the judge that she had made it up.

So her reputaion got ruined. She lost a lot of friends. Me? Well, I wouldnt say I stopped being her friend. I didnt talk to her as much, and I didnt hang out with her for different reasons. I agree that was a really horrible, inexusable thing she did. But you know, she admitted the truth and did the right thing in the end. Shes only human, slutty or not, so I gave her the benefit of the doubt that EVERYONE makes mistakes. Even though I wasnt directly involved, I forgave her. I wish everyone else would too.

Anyways, my whole point is, with a good majority of rape cases, the truth nearly ALWAYS comes to light in the end.

 Eh I know if I were the guy I'd never forgive her.

Not a bleeding heart myself, if anyone ever pulled a stunt like that and it affected me or one of my friends.. naw I'm the damning type. There aren't many things more despicable than someone who "cries rape" just cause.

The dude's not getting his ruined days back at all.. no monetary compensation for defamation of character (very illegal) and what bad actually happened to the girl who admitted what she did.. nothing? I wouldn't be surprised.. so it's still a horrible loss for the guy.

But that's just me.

Also, if someone is in court court for something involving a rape.. a judge alone doesn't decide anything, the jury does.. if there was no jury, it wasn't exactly an actual court because you don't take something like rape to small claims.. if you get what I mean.
