Why in the world would you promise this type of consequence on the basis of your users using a valid operation on your console, one that you put on there? The rationale is insane. And so is their attitude about any objections to the terms of service. All companies have made similar actions in the past, although I can't recall any that actually told you to terminate your account if you didn't like it. What jerkwads.

Downloads give faceless corporations too much control over your purchases. But if this is true, then it looks like even this precaution won't protect me. At least with the Genesis and the PC, I can do whatever I want because it's my property. Rentalware and DRM are evil. It was said ironically to further highlight the inanity of Sony's actions. xD And I'd argue that you actually can't do anything and everything you want with your computer. Can't argue about property laws when the FBI picks you up for your large-scale copyright infringement and child pron scams! But my snarkiness aside, this would be much more sensible if it was only applicable to their online services.

Less issues concerning what you can or can't do. Yet I found this highly unlikely. Why would Sony even want to create a scene like this. The crowds won't be pleased. EDIT: I read over the terms of agreement. It does say that some upgrades may result in a loss of data, but it says nothing about having us terminate our accounts if we didn't agree with it.
