Nintendo has been accused of stealing so many patents that I now consider it a mandatory business practice. However, finally getting caught with their pants down isn't going to stop Wii production; no sensible judge would ever do that. Nintendo's just going to pay the people a large sum of money like every other thieving corporation does and that will be the end of it. |

All these companies do is sue big companies when they are successful... Just like Immersion suing Microsoft and Sony for rumble technology. Now I hear Sony is getting Sued for Blu Ray, because it infringes on a patent and the small company says using multiple layers on a disc is their technology... Well DVDs have been using dual layers for years, but they didn't sue DVD companies. Plus Sony isn't the owner of Blu Ray anyway... Idiots!! |

As someone who sees power in patents and copyrights and is protective over her own artistic creations herself, I can't agree with the other side of the argument. If I create something and patent it, it's mine and that's all there is to it. If you want to use what I've got, pay me for it instead of taking it and passing it off as your own "innovative technology". The morality of the issue a two-way street. Of course there's an element of jealousy that can possibly be attributed to these companies' actions, but by the same token why should these big companies get away with it just because they're big companies? That isn't fair to those who actually spent the time pioneering and creating the technology they're unfairly capitalizing off of. I say if you've got undeniable proof that your patent has been stolen, sue that person for everything they've got. Edit: However, I have to admit that Blu-Ray issue sounds very awkward.... I'm going to look that up myself. |

I say sue them when they infringe on your patents, don't wait 5-10 years before you suddenly realize something. Plus a lot of these companies just patent technology and never use it, they just beat people to the punch so when it is made, they can sue. Sometimes(like the blu lazer diode in the Blu Ray/HD-DVD) these patents are so vague that they can sue for anything that remotely falls into the description, even if that is nothing related to what they patented. So wait, Ninteno stole this idea from something? Pretty bad to see that it won't be selling around the US anymore, I mean I don't plan on getting on, but it seems that are others that do. I just hope they have seen this video because if not they might not look so good. I wonder if it is true? If nintendo are thieves xD But there is nothing to do but wait and see I suppose. |

Are any of us even sure how long it takes to build a solid case regarding a patent infringement of technology? I don't think anyone who's ever filed a patent lawsuit waits a long amount of time just fiddling their thumbs while waiting to see how the product turns out. That's ridiculous. It's not like suing for battery where evidence can be gathered immediately; proving that a company's patent matches your own is probably no cakewalk when you consider that patents can be especially huge documents. And of course companies don't use a lot of their patents. That's the whole purpose of one-- it "provides the right to exclude others from making, using, selling, offering for sale, or importing the patented invention for the term of the patent, which is usually 20 years from the filing date." Overall, it doesn't matter if a person hasn't used their patent or not. The fact is it's still their invention. It's their property. You can't make a good case for theft on the basis of, "Oh, well, they weren't using it". Law dictates that you're still a thief and should pay for it. I also wouldn't call this particular case frivolous. The people are basically saying "Nintendo is using my technology without permission." Until we can witness Nintendo's course of action, saying the case is absurd is absurd in itself. However, what is frivolous is that Sony Blu-Ray case you mentioned. They're suing the wrong people indeed.

It certainly doesn't take 10 years like that Immersion case or else you would have seen it in the news of them filing a case years ago. They filed the case nearly 10 years after Sony created the Dual Shock. Not went to court, FILED, so they waited that long... These people aren't legitimate, they are in it for the money, they don't care if they used their technology. Like that one about Blu Ray... The patent was filed in 1930(before any such technology came out) that anything emitting blue light, or something like that, was theirs... It was complete bull, and I think they lost. |
