You don't have to make a profit off of something to violate copyright claims or damage business. Quick question: If you could get a near-identical copy of a game for free without pirating it, would you buy an official port? Most logical people would say no, hence you just cost Sega business by providing people a better alternate option. And being a fan remake down to the point where it aims to replicate the original code is what puts this game squarely in line to be dismissed as copyright infringement regardless of its ultimate status as a fan game. Unlike other fan games with a greater degree of original content even in the engine, there's less room to suggest this game falls under fair use. Ergo, Sega have a leg to stand on legally. Morally though, I think this is bunk, the absolute worst way to communicate with your fans. |
